Family Law Litigation

Family Law Agreements
Our attorneys create carefully-drafted premarital, postmarital, cohabitation, and domestic partnership agreements so that the spouses understand one another's expectations from the beginning, minimizing or eliminating the need for future litigation in a divorce.
Child Custody and Support
Divorcing spouses will ideally reach an amicable agreement on child custody issues through an alternative (consensual) form of dispute resolution. However, if litigation proves the proper avenue to resolve these issues, the court will order an arrangement believed to be in the best interests of the children, generally seeking to foster a continuing relationship with both parents. The parent who is not awarded physical custody is given visitation rights, and is typically ordered to pay child support in an amount determined by a formula dictated by the California Family Code.
Spousal Support
In some cases, the court will order a period of spousal support (sometimes known as alimony) to be paid by one of the parties, depending on such issues as the length of the marriage, the relative earning capacity of both spouses, and the standard of living established during the marriage.
Parent's Rights and Parentage
The issue of parentage, and subsequently the parents' rights, usually arises when parents were not married when a child was born and there is a dispute as to the identity of the child's father (paternity). Parents who were not married at a child's birth can sign a Voluntary Declaration of Paternity or ask for genetic testing later in court. Once paternity has been established, the legal parents are ensured certain custodial and decision-making rights over their children, and are responsible for supporting their children financially.
